Please carefully review this section, as it impacts your rights. It establishes the resolution of most disputes through arbitration instead of court trials and class actions. Arbitration is a final and binding process, subject to very limited review by a court. This arbitration provision remains in effect even after the termination of this agreement.
If a dispute arises between you and Celeste Media Film Production, our objective is to offer a neutral and cost-effective method for promptly resolving the dispute.
a. Negotiations. Before initiating any arbitration or court proceedings, you and Celeste Media Film Production commit to making an initial effort to informally negotiate any dispute, controversy, or claim related to the Website, these Terms of Service, or the Privacy Policy. Such matters may be based on contract, tort, statute, fraud, misrepresentation, or any other legal theory (each referred to as a “Claim”) for a minimum of thirty (30) days. Negotiations commence upon written notice. Celeste Media Film Production will send its notice via Certified Mail to your billing or other known physical address, if on record with Celeste Media Film Production, and will also email a copy to the email address you’ve provided. Your notice should be sent via Certified Mail to Celeste Media Film Production’s General Counsel’s Office, at the address specified in Section 8 of these Terms of Service, along with an email copy to [email protected]
b. Binding Arbitration. If the parties are unable to resolve a Claim through negotiations within the aforementioned thirty (30) day period, you and Celeste Media Film Production agree that, with exceptions as expressly provided herein, all Claims will be conclusively and exclusively settled through binding arbitration. Either party can initiate this arbitration by sending a written notice requesting arbitration to the other party, except when: (a) Claims qualify for hearing in a small claims court, or (b) Claims solely pertain to the collection of any debts you owe to Celeste Media Film Production. Nevertheless, for those Claims that could be taken to court, both you and Celeste Media Film Production waive any Claims for punitive damages and any right to pursue Claims on a class or representative basis. The arbitration choice made by one party will be considered final and binding on the other.
c. In the event of any dispute arising between you and Celeste Media Film Production during your use of the Site or arising thereafter in connection with your use of this Site, the dispute shall be referred to the Dubai International Arbitration Centre (DIAC) for resolution. The place of arbitration shall be Dubai, United Arab Emirates, and the arbitration proceedings shall be conducted in the English language, governed and construed in accordance with the Arbitration Rules of DIAC.
d. Exceptions to Negotiations and Arbitration. You and Celeste Media Film Production concur that the following Claims are not subject to the aforementioned provisions related to negotiations and binding arbitration: (i) Claims seeking to enforce or protect, or concerning the validity of, any of your or Celeste Media Film Production’s intellectual property rights; (ii) Claims related to or arising from allegations of theft, piracy, invasion of privacy, or unauthorized use; and (iii) any claim for equitable relief. Additionally, either party may bring an individual action in a small claims court for Claims within the jurisdiction of such courts instead of arbitration, provided that any such action or proceeding must be initiated no later than one year after the Claim accrues.
e. Severability. You and Celeste Media Film Production agree that if any part of this “Dispute Resolution” section is deemed illegal or unenforceable, that portion will be separated, and the remainder of this section will remain fully effective.

YOU SPECIFICALLY ACKNOWLEDGE THAT CELESTE MEDIA FILM PRODUCTION SHALL NOT BE LIABLE FOR USER SUBMISSIONS OR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY, AND THAT THE RISK OF HARM OR DAMAGE FROM THE FOREGOING RESTS ENTIRELY WITH YOU.
